Terms of Service

These Terms of Service ("Terms") govern your use of Foxel ("Software"), developed and distributed by Minddesk Software GmbH, a company based in Germany ("we", "us", or "our"). By purchasing, downloading, or using Foxel, you agree to be bound by these Terms.
1. Product Overview
Foxel is a downloadable voxel editor designed for professional artists, game developers, and advanced hobbyists. It is available for purchase through our website at https://foxel.io.
2. Eligibility
You must be at least 16 years old, or have the consent of a parent or legal guardian, to purchase and use Foxel.
3. Licensing
When you purchase Foxel, you are granted a non-exclusive, non-transferable license to install and use the Software in accordance with the license terms provided at the time of purchase. You do not acquire ownership of the Software.
4. Payments
All payments are processed via Paddle, our payment provider. Pricing, billing cycles (for subscriptions), and applicable taxes are displayed at checkout. For subscription products, recurring billing is handled through Paddle’s self-service portal, where you can manage or cancel your subscription.
5. Refunds
We offer an unconditional 30-day refund for purchases of perpetual licenses of Foxel.
Subscriptions and update extensions are not eligible for refunds.

6. Usage Restrictions
You agree not to:
- Distribute, resell, sublicense, or otherwise transfer the Software without our written consent.
- Reverse engineer, decompile, or modify the Software.
- Use the Software for unlawful purposes.
- Attempt to interfere with the functioning or security of the Software.

- Discord: through our official Discord server’s ticket system.
We aim to respond in a timely manner but do not guarantee resolution times.
8. User-Generated Content
Our community (e.g., Discord server) may allow the posting of user-generated content (UGC) such as artwork, comments, and feedback. You retain ownership of your UGC, but you grant us a non-exclusive, worldwide license to display and share this content within the community context. You are responsible for ensuring your content complies with applicable laws and community guidelines.
9. Intellectual Property
All content related to Foxel—including but not limited to software code, branding, graphics, and documentation—is the intellectual property of Minddesk Software GmbH. You may not use our intellectual property without prior written permission, except as permitted under these Terms.
10. Disclaimer of Warranty
Foxel is provided “as is” without warranty of any kind, express or implied. We do not guarantee that the Software will be error-free or that access will be uninterrupted.
11. Limitation of Liability
To the extent permitted by applicable law, Minddesk Software GmbH shall not be liable for any indirect, incidental, or consequential damages arising from the use of or inability to use Foxel.
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
The courts of Kiel, Germany shall have exclusive jurisdiction over any disputes arising from these Terms.
13. Changes to Terms
We may update these Terms from time to time. The latest version will always be available on our website. Continued use of the Software after any changes constitutes acceptance of the updated Terms.
